Contested Divorce. If you and your spouse are not able to reach any sort of agreement, we can file a petition for dissolution of marriage with the court. Once the petition is filed, we can work to negotiate an agreeable settlement. If we cannot reach a settlement, we will try to reach an agreement in mediation. If there is no other alternative, we will be prepared to argue your case and advocate your position to the court.
Collaborative Divorce. We can also represent parties in collaborative divorce, which is a process where a team of professionals, including independent attorneys and neutral psychologists and financial professionals, help you and your spouse reach a settlement agreement that that best fits your needs. Collaborative divorce is less expensive than a contested divorce, but it is more expensive than a divorce mediation or filing an uncontested divorce. Also, if you elect to use a collaborative divorce procedure and later decide to litigate your divorce in court, your collaborative attorneys cannot represent you in court.
Divorce Mediation. If you and your spouse would like to attempt a confidential mediation and finalize your divorce without incurring the expense or difficulties of litigation, we can act as neutral mediators and try to help you reach a marital settlement agreement that is satisfactory to both parties. If you hire us to conduct a divorce mediation, we cannot represent either party in the mediation or in connection with the divorce.
